Regulations

Article 1 - Register

  1. Entrepreneurs need to register by means of the application form on the Caribbean Style website.
  2. The entrepreneur provides the information asked in the application form and agrees to all the conditions drawn up by Caribbean Style, including the privacy statement.

Article 2 - Membership and costs

  1. From the moment the entrepreneur registers at Caribbean Style, the entrepreneur enters a membership for a period of four years.
  2. The membership is automatically renewed after a period of four years with a period of four years.
  3. Every year the entrepreneur receives an invoice that has to be settled according to the Rinkes & Rinkes general terms & conditions.
  4. As soon as the first invoice has been settled, the accommodation will be entered into the public classification register and published onto the Caribbean Style website.

Article 3 - Classification register

  1. Caribbean Style has drawn up a public classification register, in which accommodations are included.
  2. Caribbean Style draws up the regulations and manages the public classification register.
  3. The public classification register contains at least:
    1. the country the accommodation is located in;
    2. the name of the accommodation together with, if desired, the listing of the classification;
    3. the accommodation (postal) address;
    4. the telephone-, fax-, and mobile phone number;
    5. the e-mail and internet address.
  4. The data mentioned at section 3 will be published onto the Caribbean Style website and are available for everybody free of cost.

Article 4 - Classification

  1. After the entrepreneur has registered, the accommodation will be classified.
  2. Therefore the entrepreneur needs to fully and truthfully fill out one classification form for every accommodation.
  3. After settling the invoice the classification form will be dealt with.
  4. On the base of the classification form a classification will be made and a number of stars (with a maximum of five) will be appointed.
  5. Furthermore, there will be decided according to the classification form whether the ecolabel will be appointed.

Article 5 - Classification system

  1. Caribbean Style draws up the classification system for the classification of accommodations in different categories.
  2. Caribbean Style reserves the right to alter the classification system at all times and without any reasons given.
  3. An accommodation will be classified in the highest category to where it completely meets the requirements according to the assessment.

Article 6 - Modification and removal

  1. With confirmation of the things listed below, Caribbean Style will alter the classification in the public classification register:
    1. If the minimum number of points to be obtained of a higher category than the accommodation is classified in is conformed to. Then the accommodation will be classified in this higher category.
    2. If the minimum number of points to be obtained of the category in which the accommodation has been classified is not conformed to. Then the accommodation will be classified in the highest category to where it does completely meet the requirements.
  2. With confirmation of the things listed below, Caribbean Style will sign the accommodation out of the public classification register:
    1. The accommodation is or will be no longer exploited.
    2. The accommodation is or will be transferred.
    3. Resignation from the membership by the entrepreneur at a two month's notice.

Article 7 - Dispensation

  1. On demand of the entrepreneur, Caribbean Style may allow dispensation from one or more standards that are determining for the classification.
  2. A request for dispensation has to be submitted to Caribbean Style in writing with reasons given.
  3. Dispensation can only be allowed if the entrepreneur can, in fairness, not be asked that the accommodation has to come up to the standards that apply to the concerning classification.
  4. Caribbean Style may allow dispensation for a fixed period of time.
  5. Caribbean Style may place terms on allowing the dispensation.
  6. Regulations with relation to the allowing of dispensation will be determined by Caribbean Style.

Article 8 - Not allowed

  1. The entrepreneur is not allowed to provide false or incomplete information concerning application, classification, or when requesting for dispensation.
  2. The entrepreneur is not allowed to define an accommodation exploited by this person, as if being classified in a different category of the public classification register, other than the category in which the accommodation has been classified.
  3. The entrepreneur is not allowed to behave in such a way that by doing so the consumer may get the impression that the entrepreneur is entitled to make use of a different category of the classification register, than in which the accommodation has been classified.
  4. The entrepreneur is not allowed to not inform Caribbean Style of changes that in whichever way may be of influence on the contract.

Article 9 - Objections and appeal

  1. If the entrepreneur disagrees with a decision made by Caribbean Style, the entrepreneur can present a notice of objection to Caribbean Style.
  2. The notice of objection needs to be presented by means of the contact form and within two weeks after the aforementioned decision, stating name and address.
  3. The notice of objection needs to contain the description and reason of the objection.
  4. As soon as Caribbean Style receives the notice of objection, the entrepreneur will get a acknowledgement of receipt.
  5. When judging the notice of objection all aspects that have played part in making the aforementioned decision will be reviewed. Within six weeks after receiving the notice of objection Caribbean Style has to make a decision concerning the notice of objection. In some cases this period will be extended, for example when during the dealing with the notice of objection it becomes clear that the entrepreneur still has to provide further information.
  6. If the notice of objection is certified to be unfounded, the entrepreneur can appeal against it.

The Dutch version of these regulations prevails at all time in case of disputes with regard to the interpretation and purpose of these regulations.
